Sexual Harassment Lawsuit for Delaware School District

A lawsuit has been filed charging the Cape Henlopen School District with failing to act when a former high school student was inappropriately touched by a stage manager.

The incident allegedly occurred in 2015 when Theresa Collins was 17.

The Wilmington News Journal reports that she and her mother Virginia say the former district employee Derek Dutton had acting inappropriately with several students and committed assault and battery.

The suit said that Assistant Principal Nikki Miller, also a defendant, failed to follow up on her promise that authorities would be called in to take care of the issue.

In addition, the suit alleges that even after being promised that Dutton would no longer be on campus they ran into him on school grounds as late as 2017 and 2018.

The plaintiffs are looking for compensatory and punitive damages for mental anguish and emotional distress suffered by the family.
