Death Penalty Still on the Table Joseph Szcerba Murder Trial

A Superior Court Judge in Delaware has rejected a request by defense attorneys that the death penalty be taken off the table in the stabbing death of New Castle County police officer Joseph Szczerba two years ago.

The Wilmington News Journal reports that court documents show that 34 year-old David Salasky has both a long criminal history and a history of mental health issues.

Salasky was reportedly high on chemical known as bath salts when he allegedly stabbed Szczerba.

The judge also rejected defense motions to exclude certain evidence.
