The lawsuit against the Mayor of Berlin and town council by the former paramedics supervisor has been dismissed.
Norris Phillip Donohoe claimed he was wrongfully terminated.
But, Judge David Mitchell dismissed the case citing immunity that covers government officials.
The judge has been given 21 days to amend the complaint.
Donohoe’s attorney Robin Cockey told the Salisbury Daily Times that he would do just that and plans to move forward with the case.
Donohoe had served as a paid paramedic in the Berlin Fire Company for 23 years but was fired after the town got complaints about sexual harassment going on in his department.
His complaint charges that he was terminated upon the threat by the Mayor and City Council to end the town’s funding to the fire department if Donohoe continued with the department.
Even after Donohoe left and fire company volunteers went through anti-harassment training, Mayor Gee Williams said town officials were still getting complaints of harassment in August.
