DOVER, Del. (AP) - Delaware's Supreme Court has rejected the appeal of a man who sued state police after being shot inside his home by a trooper investigating a hit-and-run incident involving a parked car.
Michael Rogers was shot five times after fighting with trooper Matthew Morgan in 2013. His lawsuit alleged invasion of privacy, excessive force and other claims.
After a judge granted summary judgment for state police on most counts, a jury rejected Rogers' excessive force and negligence claims.
On Tuesday, the Supreme Court upheld the judge's ruling that Rogers' privacy claims were invalid because his mother had allowed Morgan into their Georgetown home.
Authorities concluded in 2014 that Morgan was justified in using deadly force.
After a mistrial, Rogers pleaded no contest to resisting arrest and was sentenced to home confinement.
