Ocean City Goes to Court Over Dumser Property

Dumser's Dairyland website

Ocean City is taking its case to Maryland’s highest court over the Boardwalk establishment of Dumser’s Dairyland.

At issue is: Who owns the land where it is located.

The Salisbury Daily Times reports that the issue of ownership began in 2016.

There had been two 25-year contracts for the Rapports and their heir who were allowed to build the shop and an apartment on the property.

When the second contract ran out Ocean City told the family that they had to vacate the property.

But the family argued that it now owned the land by “adverse possession” where someone has occupied land by a claim for at least 20 years.

Ocean City argued that Dumser’s was located on land dedicated public easement.
