Developments Can Be Forced to Fund Road Improvements, Court Rules

New Castle County can deny construction projects if developers fail to deal with the traffic congestion through road improvements.

A Superior Court ruled that the county can force developers for a project at the former Hercules Country Club in Mill Creek to fund road improvements even though they have argued that this would place an unfair burden on their projects.

County Executive Tom Gordon told the Wilmington News Journal that the decision sets in place “a good rule” for future development.

The Hercules development reaches back six years and envisions 264 in the Red Clay Creek area.
