DOVER, Del. (AP) - A Delaware judge has overturned the conviction and death sentence of a man found guilty in the shooting deaths of two men in Wilmington 20 years ago.
In a ruling Wednesday, the judge questioned the fundamental legality and fairness of Luis Reyes' trial.
The judge said Reyes' attorney was ineffective, and that Reyes' decision to invoke his Fifth Amendment right not to testify was neither knowing nor voluntary. She also said the a key prosecution witness's testimony was "highly suspect," and that a delay in sentencing co-defendant Luis Cabrera Jr. made him unavailable as a witness in Reyes' trial.
Reyes and Cabrera were sentenced to death in 2002 for the 1996 murders of Brandon Saunders and Vaughn Rowe.
The judge vacated Cabrera's death sentence last year, but upheld his conviction.
