No Secrecy for NCCA in Brain Death Suit

The Derek sheely Foundation website

ROCKVILLE, Md. (AP) - A judge has largely rejected an NCAA bid for secrecy in a civil lawsuit stemming from the brain-injury death of a Frostburg State University football player.

The NCAA had sought to shield from public view 14 internal emails, memos and meeting minutes it considered confidential records of its decision-making process regarding concussions. The Montgomery County Circuit Court judge rejected that argument for 11 of the documents in an order filed Tuesday.

The ruling comes nearly four years after the death of 22-year-old Derek Sheely of Germantown, Maryland. His parents say the NCAA, two coaches, an athletic trainer and helmet maker Kranos Corp. were negligent in his death. The defendants have denied the allegations.

The case is set for dismissal hearing Dec. 7, and for trial in June 13.
