BETHANY BEACH, Del. (AP) - A judge in Sussex County has dismissed a charge against a Bethany Beach police officer accused of assaulting a man in custody.

Superior Court Judge E. Scott Bradley granted a motion for acquittal Wednesday from Lt. Richard Haden's defense after several hours of testimony from prosecution witnesses.

Haden faced one count of misdemeanor third-degree assault. The police chief contacted the attorney general's office after reviewing video of Haden interacting with a man in police custody on suspicion of drunken driving in March. Haden was indicted in April and suspended without pay pending the outcome of the court case.
