Rehoboth Beach Police Officer Cleared in Taser Kicking Incident

REHOBOTH BEACH, Del. (AP) - The Delaware Department of Justice has found that a Rehoboth Beach police officer who kicked a man's head during an arrest did not use excessive force because the man was trying to bite him.

Justice officials announced Monday that Cpl. Robert Whitman was cleared after an investigation into a complaint by the man Whitman was arresting, Jeremy Anderson.

The Department of Justice report says the Crosswinds Motel called police in April after a clerk refused to give Anderson the key to his girlfriend's room and he returned several times. The report says Anderson did not cooperate even after officers stunned him and he tried to bite Whitman. The report states that Whitman reasonably believed his actions were necessary to protect himself.

Anderson pleaded guilty to resisting arrest and other violations.
