DOVER, Del. (AP) - A Delaware Chancery Court judge has dismissed a lawsuit filed against the Kent County SPCA by a couple who claimed the organization violated state animal control regulations in euthanizing a dog they wanted to adopt.
The judge ruled Thursday that the couple had no standing to sue, noting that they didn't own the dog and had no legally protected interest in the animal, a stray pitbull mix that had befriended their son in December.
After turning the dog over to the SPCA, the couple later expressed interest in adopting it, but allegedly were told it was unsuitable for private adoption.
The couple accused the SPCA of violating rules for euthanizing animals and of fabricating results of temperament tests to justify the killing of dogs based on their alleged aggressive behavior.
