The Somerset County Sanitary Commission says it will appeal a recent Circuit Court decision that would require them to spread out front foot assessments among all users in the area not just a few properties.
Visiting Judge Dale Cathell from Worcester County agreed with the plaintiff developer Howard “Butch” Malone in his suit against the Sanitary District.
The Salisbury Daily Times reports that he ruled that the Sanitary District could keep the benefit assessment that has already been collected from Malone but that it could not resume such collections until it had reapportioned the front foot assessment for the entire Princess Anne Subdistrict.
After a recommendation to build a new sewage line for planned apartments on UMES Boulevard the paper reports that the Commission decided to extend the new sewer line to other new developments being planned on the west side including Malone’s Westfield Estates.
Higher fees are also being charged to several student apartment complexes on UMES Boulevard the Princess Anne Village shopping center and another planned housing development.
