Delaware Court Battle Over Hyphenated Name

DOVER, Del. (AP) - A Delaware judge says a lower court erred in denying a woman's request to hyphenate her son's surname with her new married name.

The judge ruled this week that the denial of Brittany Haas' request to change her 6-year-old son's last name from Wilson to Wilson-Haas was based on the wrong legal standard.

Haas's attorney is Democratic state Rep. Sean Lynn.

Under legislation Lynn sponsored in 2017, there is a presumption in favor of granting a request to add a parent's surname to a child's surname, either as an additional name or with a hyphen.

Instead of using only the new law, the lower court also considered the previous legal standard of determining what was in the best interest of the child when a parent requests a name change.
