Ocean City has issued its defense in a lawsuit over its topless ban for women.
The plaintiffs claim that it violates the equal protection clause under the 14th Amendment as well as the Declaration of Rights to the Maryland Constitution.
The Salisbury Daily Times reports that attorneys for the resort counter that going nude in public is not a right.
They argued that one does not have the right to impose one’s lifestyle on others who have the right to be left alone.
They noted that there are “indisputable differences between the sexes” that causes the government to intervene to protect the public’s sensibilities.
The lawsuit was filed by Salisbury resident Chelsea Eline among others in January.
She is an advocate for topless freedom.
